Terms of Service
Effective: 2 September 2026 Last updated: 2 September 2026
1. Who you are agreeing with
These terms are between you and:
Mohamed Aziz Talbi
Schlörstr. 6, 80634 München, Germany
support@gigaway.app
By creating an account you accept these terms. If you do not accept them, do not use GigAway.
2. What GigAway is, and what it is not
GigAway is a directory and introduction service for professional performing artists. It lets members find each other by city and date, and arrange informal hospitality between themselves.
GigAway is not an accommodation provider. Read this section carefully, because it defines the limits of what we do.
- No money changes hands in the app. There is no payment system, no deposit, no fee, and no commission. GigAway earns nothing from any stay.
- GigAway is not a party to any arrangement between members. When you agree to host or to stay, that agreement is between the two of you. We are not a landlord, agent, broker, insurer or guarantor.
- We do not inspect homes. We have never seen any member's home and make no representation about whether it is safe, clean, legal or as described.
- We do not vouch for members. Verification confirms professional standing as an artist, and that the name on the account matches a selfie taken holding photo ID. It is not a formal identity check, a background check, a criminal record check, or a statement that someone is safe to stay with.
3. Eligibility
To use GigAway you must:
- Be 18 or older
- Be a professional or pre-professional performing artist
- Have your application approved after review by a human
- Provide accurate information about yourself
One person, one account. Do not create an account for someone else, and do not share yours.
4. Verification
Every application is reviewed by a human: a selfie of you holding photo ID, taken against a pose we specify at the time so it cannot be an old or reused photo; the full legal name on that ID; and evidence of your professional standing, such as a CV or links to your portfolio, projects, video work or social profiles. We may approve or reject any application at our discretion, and we are not obliged to explain a rejection in detail — a rejected application may be submitted again.
The selfie, the ID and the CV are retained for as long as your account exists — not deleted once a decision is made, and not on a fixed schedule — so a decision can be revisited and the fact that a real human was checked stays part of your record. See Section 7 of the Privacy Policy for the full detail.
5. Your responsibilities when you host or stay
This is the section that matters most.
You are responsible for your own safety. Read profiles and reviews, ask questions, and do not agree to anything you are not comfortable with. You can withdraw from any arrangement at any time, for any reason, including after agreeing to it. Nothing in GigAway obliges you to go through with a stay.
You are responsible for your own legal position. Hosting a guest may require your landlord's permission, may affect your tenancy, and may have tax or registration consequences where you live. Some leases prohibit guests. Some cities require registration of visitors. Checking this is your responsibility, not ours.
You are responsible for your own insurance. GigAway provides no insurance of any kind. Your home contents insurance may not cover guests, and your travel insurance may not cover an informal stay. Check before you agree.
Be honest. Describe what you are actually offering. If your "couch" is a mattress in a shared kitchen, say so. Misrepresentation is grounds for removal.
Turn up, or say you cannot. Cancelling late leaves someone without a bed in a city they do not know. If plans change, say so as early as you can.
6. What you may not do
You may not:
- Charge money, request payment, or offer accommodation commercially
- Use GigAway to advertise, recruit, sell, or promote anything
- Harass, threaten, intimidate or discriminate against another member
- Misrepresent who you are, your professional standing, or what you are offering
- Share another member's contact details, photo or messages with anyone else
- Enter a member's home for any purpose other than the agreed stay
- Take photographs inside someone's home without their permission
- Create multiple accounts, or return after removal
- Attempt to bypass verification, or access data you have not been granted
- Use GigAway for anything illegal
7. Contact details
Contact details are revealed only when a stay is agreed, and only to the other person involved.
Those details are given to you for arranging that stay. Do not pass them on, publish them, or add them to a mailing list. Misusing another member's contact details is grounds for immediate removal.
8. Reviews
After a stay, both parties may review each other. Reviews are attributed to you by name and published double-blind — neither is shown until both are submitted, or 14 days have passed.
Write honestly and about your own experience. We may remove reviews that breach the community guidelines, contain personal data about third parties, or are retaliatory rather than descriptive. We do not remove reviews for being unflattering.
9. Reporting, and what we do about it
You can report any member from their profile or from a stay.
Reports are confidential. The reported person is never shown the report, and never told who made it.
We aim to review every report within 24 hours. Depending on what we find, we may take no action, contact those involved, issue a warning, suspend an account pending investigation, or remove a member permanently.
Suspension takes effect immediately. A suspended account loses access to all member content at once.
Reports are retained even if the reported member deletes their account, so that deleting and rejoining cannot clear a safety record.
If you are in danger, contact the emergency services first. GigAway is not an emergency service and cannot intervene in a live situation. In the EU, call 112.
10. Suspension and removal
We may suspend or remove your account if you breach these terms or the community guidelines, if we receive credible reports about your conduct, if your verification turns out to be inaccurate, or if we reasonably believe it necessary to protect another member.
Where it is possible and appropriate, we will tell you why. Where telling you would expose a reporter or compromise someone's safety, we may not.
11. Deleting your account
You can delete your account at any time, from Settings. Deletion is irreversible.
Some records survive in anonymised form — stays you took part in, published reviews you wrote, reports in both directions, and blocks made against you. Section 7 of the Privacy Policy explains exactly what is erased, what is kept, and why.
12. Liability
GigAway is provided as it is. We do not warrant that it will be available without interruption, free of faults, or that any member will behave well.
To the fullest extent permitted by German law, we are not liable for:
- Anything that happens during, before or after a stay, including injury, loss, theft, damage to property, or a dispute between members
- The conduct of any member, whether online or in person
- The accuracy of anything a member says about themselves or their home
- A stay that is cancelled, refused, or that does not happen
- Consequences of your own tenancy, insurance or tax position
Nothing in these terms excludes liability that cannot be excluded by law — including liability for death or personal injury caused by negligence, for intent or gross negligence, or under the Produkthaftungsgesetz. Your statutory consumer rights are unaffected.
13. Your content
You keep ownership of everything you post. You grant us a non-exclusive, royalty-free licence to store and display it inside GigAway for as long as your account exists, solely to operate the service.
You confirm that you have the right to post what you post, including any photo you upload.
14. Changes to these terms
We may update these terms. If a change materially affects your rights we will notify you in the app before it takes effect. Continuing to use GigAway after that means you accept the new terms.
15. Governing law
These terms are governed by German law. The place of jurisdiction is Munich, to the extent permitted by law. If you are a consumer, you may also bring proceedings where you live, and mandatory consumer protections of your country of residence still apply.
We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board, and do not do so.
